THIS AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU AND NESTA. BY CLICKING THE “I AGREE” BUTTON, OR BY ORDERING, ENROLLING IN A LIVE TRAINING, COURSE OR MEMBERSHIP WITH NESTA, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. Payment Methods Ordering Membership Refund Policy Please note: If the student cancels prior to taking the exam, the student will need to take the exam immediately after cancelling their membership. If the student cancels after receiving their certification, the graduate keeps his/her designation but monthly access and benefits will be terminated. Exam Extensions and Retest Fees After 30 days, the student will be given access to take the certification exam online. If the student is not ready to take the exam after 30 days, the student will have a total of 120 days following their enrollment in the course before they must take the exam. Two exam attempts are included in the initial program price. If the student is still not ready to take the exam after 120 days, the student must pay an exam extension fee of $95. The extension will provide the student another 90 days to prepare for the exam. The exam is not timed. The exam should take 2 - 3 hours to complete. If the student fails the exam after two attempts, the student can request a final extension and two (2) more attempts for $95. For extension or retest fee instructions please contact us via email. Discounts or Sale Pricing Offers Offers given after a program has been purchased will not be adjusted. Pricing is "as listed" at the time of purchase. No credits or adjustments will be issued after a program is purchased. Administration Fees If a student requires additional documentation from NESTA/MMACA (copy of certification, verification of certification, transcripts etc.) the student will be responsible to pay $25 for additional assistance outside of the normal customer support assistance. Program Transfers The MMACA certification program cannot be transferred to another individual. Privacy Policy The MMACA will not discuss a student’s account with anyone other than the student, unless the student provides permission in writing. Limited student information (verifying membership or graduate) information can be released to an employer unless the student has requested to seal their records. Periodically, we will distribute an email or direct mail to let you know about local workshops, new programs, and special announcements. Limitation of Liability Under no circumstances shall The MMACA be liable for any losses or damages whatsoever, whether in contract, tort or otherwise, from the use of the information provided in our business development programs, educational products, or consulting services. For purposes of this section, The MMACA shall include any divisions, subsidiaries, successors, parent companies, and their employees, contractors, partners, principals, agents, and representatives, and any third-party providers or sources of information or data. When you order any MMACA educational or business program, you accept and agree to adhere to the MMACA Code of Ethics. You hereby certify that the information given to The MMACA is true, complete and correct. You further understand if any of this information is later determined to be false, The MMACA reserves the right to revoke any certification (or certificate) that has been granted on the basis hereof. You further understand that The MMACA certification does not certify or in any way guarantee the quality of your work as an MMACA-certified professional. You therefore agree to indemnify and hold harmless The MMACA, its officers, directors and staff from any claims due to negligence, omission or faulty advice that I may give to clients as a MMACA-certified professional. I understand that The MMACA is not responsible for any actions or damages from any person arising out of my work as an MMACA-certified professional.
